The following terms and conditions ("Terms and Conditions") govern your access and use of Aflac* Business Services. By using Business Services, you agree, on your own behalf and on behalf of the account you represent, to be bound by these Terms and Conditions. You further represent and warrant on a continuing basis that you are authorized by all necessary parties to access the account information available through Business Services and to provide and modify information regarding the Aflac account you represent through the Business Services. Aflac may request confirmation of your authorization at any time. Nothing in these Terms and Conditions is intended to expand, restrict or otherwise modify any terms and obligations provided under any other contract or agreement between you and Aflac related to the Aflac account you represent and the terms of any such contract or agreement shall continue in full force and effect and shall apply to your use of the Business Services, as applicable. Information that you submit to Aflac is subject to review and verification by Aflac and all policy provisions contained in your policy remain in effect.
Access Rights. Upon approval of your registration for Business Services by Aflac, Aflac provides you a limited, personal, revocable, non-transferable right to access and use the Business Services solely for internal business purposes and solely as permitted under your applicable user profile, subject to compliance with these Terms and Conditions. Except as may be permitted for legitimate internal business purposes to record or archive the results or activities under the Aflac account you represent or as otherwise authorized by Aflac in advance in writing, you may not modify, reformat, copy, display, distribute, transmit, publish or sell any information obtained through use of the Business Services. As a condition of use of the Business Services, you represent and warrant to Aflac that you will not use the Business Services for any purpose that is unlawful or prohibited by these Terms and Conditions or any other contract or agreement between you and Aflac. Aflac may terminate, suspend or restrict your access, and the access of the account you represent, to Business Services at any time and for any or no reason. Not all products and services provided under the Business Services are available in all states and you may not be eligible for all products and services. Aflac reserves the right to determine your eligibility as permitted by law.
User ID and Password. Access to and use of the Business Services is restricted to authorized users only. You agree to adequately protect and maintain the security and confidentiality of the User name and password which enable you to access Business Services. You agree that you will not allow any other person to use your User ID and password to access Business Services. You agree that you are responsible for all activities that occur under your User ID and password. Aflac shall have no liability for any loss or damage caused by your failure to protect and maintain the security and confidentiality of your User name and password.
Payroll Account Acknowledgement. Terms and conditions related to your online bill pay account and authorization for automated bill pay are set forth separately in the Payroll Account Acknowledgement document.
Consent to Electronic Transactions, Signatures and Records. By using Business Services, you consent to the use of electronic transactions and electronic signatures in connection with your use of the Business Services and the receipt of electronic versions of records regarding your transactions. You further consent to be bound by any agreement or consent you make or transmit in connection with your use of the Business Services, including, without limitation, any consent to modifications of online records, payment transactions, or receipt of records or communication from Aflac through electronic transmission. You agree that consents and agreements you make via the Business Services will be legally binding and enforceable and the legal equivalent of your handwritten signature and that you have authority to act on behalf of the account you represent.
Email Messages. You may need to make certain changes to your email account so that you can receive emails from Aflac. Please consult your email provider for assistance in making these changes so that email or spam filters do not prevent you from receiving incoming emails from the aflac.com domain. At any time while these Terms and Conditions are effective, you may obtain a paper copy of a particular document at no charge by calling Aflac's Customer Service specialists at 1-800-99-AFLAC and requesting a copy. You may terminate your consent to electronic delivery of documents at any time (except to the extent that Aflac has already taken action in reliance on such consent) by calling the same number. You are responsible for accessing, opening and reading your documents. In order to access or read any documents, you must meet the following minimum hardware and software requirements: Internet Explorer and Adobe Reader. The information you send to Aflac is encrypted. Aflac uses an industry standard Secure Socket Layer (SSL) to allow for encryption of Access Information and other personal information.
User Representations. By using Business Services, you represent and warrant that your online application, registration information and all information that you provide via the Business Services for the Aflac account you represent will be true, current, complete, and accurate when supplied and will be updated and revised as and when information previously supplied becomes inaccurate.
Accuracy and Security of Information. Account information available through Business Services from Aflac is generally current, but ANY INFORMATION AVAILABLE THROUGH BUSINESS SERVICES IS SUBJECT TO ADJUSTMENT AND CORRECTION. To the fullest extent permitted under applicable law, Aflac makes no warranties or representations as to the accuracy of the content or information available through the Business Services. Aflac uses technology tools and designs our business practices to help ensure that the information provided via Business Services is properly gathered, stored, and processed. However, transmission of information over the Internet and a password-protected system of data storage can not be made completely secure and there are no guarantees that unauthorized access or disclosure will not occur.
Confidentiality. Without limiting any other confidentiality obligations or terms of nondisclosure to which you have agreed with Aflac, you agree to maintain the confidentiality of any information available through Business Services. You further agree to use Business Services and the information therein only for the conduct of business between Aflac and the Aflac account whose information you are authorized to access.
Monitoring. You acknowledge and agree that Aflac has the right, but no obligation, to monitor the use by you of the Business Services to verify compliance with the terms of these Terms and Conditions and any other contract or agreement between you and Aflac.
Additional Disclaimers and Limitations of Liability. Aflac does not warrant the condition, completeness, availability, security or performance of Business Services at any time. Aflac makes no warranties that the Business Services will meet your needs or commercial expectations or will be error-free or uninterrupted. TO THE FULLEST EXTENT PERMITTED UNDER APPLICABLE LAW, THE BUSINESS SERVICES ARE PROVIDED "AS IS" AND WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. AFLAC HEREBY DISCLAIMS ALL WARRANTIES WITH REGARD TO BUSINESS SERVICES, INCLUDING, WITHOUT LIMITATION, ALL IMPLIED WARRANTIES OF MERCHANTABILITY, NONINFRINGEMENT, OR FITNESS FOR A PARTICULAR USE OR PURPOSE. NEITHER AFLAC NOR ITS AFFILIATES, DIRECTORS, OFFICERS OR EMPLOYEES (THE 'AFLAC GROUP') SHALL BE LIABLE FOR ANY LOSS OR DAMAGE ARISING OUT OF OR IN CONNECTION WITH THE USE OR PERFORMANCE OF BUSINESS SERVICES, EXCEPT FOR ACTUAL, DIRECT DAMAGES ARISING FROM AFLAC'S GROSS NEGLIGENCE OR WILLFUL MISCONDUCT IN PROCESSING AUTHORIZED AND PERMITTED TRANSACTIONS IT RECEIVES BY YOU THROUGH BUSINESS SERVICES. IN NO EVENT SHALL AFLAC BE LIABLE FOR ANY INDIRECT, SPECIAL, PUNITIVE, INCIDENTAL OR CONSEQUENTIAL DAMAGES ARISING OUT OF OR IN CONNECTION WITH THE USE OR PERFORMANCE OF BUSINESS SERVICES, REGARDLESS OF WHETHER ANY CLAIM FOR SUCH DAMAGES IS BASED ON TORT, CONTRACT, OR ANY OTHER THEORY OR CAUSE OF ACTION. Aflac shall not be liable for any damages to any computer equipment or system or loss of data that may result from your access to or use of the Business Services or the downloading of any materials, data or information from the Business Services. Aflac reserves the rights to revise these terms and conditions at any time. Any revisions to these terms will be posted on this page and in the same manner in which these terms and conditions are posted.
Export Restrictions. Software and other materials provided via the Business Services may be subject to United States Export Control. The United States Export Control laws prohibit the export of certain technical data and software to certain territories. You hereby agree that you will not transfer or export such software in violation of any such applicable export laws and regulations. Aflac does not authorize the use, downloading or exportation of any software or technical data from the Business Services to any jurisdiction prohibited by the United States Export Laws.
